according to billboard.com:

"...Meanwhile, other studio recorded tracks "Stealin My Girl", "Whiskey and Wine" and "Into the Flame" will be released separetely from the album. "Whiskey and Wine", a melodic jam led by Martinez, will be feeatured as an iTunes exclusive, and those who purchase the album will receieve a password to download the song for free. The other two unreleased songs will see the light of day on a future LP or single release. 'Don't Tread On Me', the band's eigth studio album, will be released July 26th."

Well SA wrote it, and during the parts when SA and Nick sing together, SA's voice sounds a bit higher in the mix. Usually when Nick and SA sing together, Nick's voice is higher. SA does seem to have the lead vocal of that song.

Whisky and Wine is getting droped from the album?? thats bs, sa said its one his favorite 311 songs????? what a mistake this song should be just as part as this recod as dont tread on me, i dont usually complain but damn they say they want to evolve, Whisky and Wine brings it out, well at least there putting Whisky and Wine on Itunes

, the god damn record companies are controling this band, the more they keep putting less of songs on there albums, than the record companies will be making more money

i'm not too sure that is real, maybe and elaborate hoax, cuz there is nothing on billboard.com that says ANY of that. pretty sure its not real, so i wouldn't get all worked up about, but im pretty sure into the flame wont make the cut, but i hope so cuz its a kickass tune

I have to agree that it's total BS to shaft SA like that. He finally actually writes music to a song, which he's only done like twice ever, and it's getting cut??!? WEAK

Way too incredible of a song to not put on the album.
